1. Object and scope of the service BioGALF Home Health is a digital HealthTech platform focused on wellness, biometric tracking, health information support, analytics, and organization of personal care processes. By creating an account or using any functionality, you fully accept these Terms and Conditions. The service may include, among others, AI Triage, progress panels, integration of laboratory results, nutrition and training recommendations, telemedicine, prescription management, and e-commerce/pharmacy functionalities operated by third parties.
2. Eligibility and user account You declare that you have the legal capacity to contract and that the information registered is truthful, updated, and complete. You are responsible for the confidentiality of your credentials and for all activities performed on your account. Do not share access with third parties without the express authorization of BioGALF. Keep your clinical, contact, and billing information updated. Notify immediately of any unauthorized access or security incident.
3. Medical disclaimer (critical) BioGALF, the AI Triage, analytical reports, and algorithmic recommendations are informational and support tools. They do not constitute medical diagnosis, do not replace the assessment of an in-person health professional, and are not an emergency service. If you present signs of urgency or emergency, you must immediately contact local emergency services (911 or its equivalent) and go to a healthcare center. No interaction within the platform creates by itself a direct doctor-patient relationship with BioGALF as an entity, except for the formal care provided by qualified professionals under their own conditions and regulatory obligations.
4. Assumption of sports and nutritional risk The user acknowledges and accepts that all physical activity, including Live Exercise modules, and any nutritional or supplementation adjustments, involve inherent risks of injury, decompensation, intolerance, adverse reactions, or unexpected results. You fully assume the risks arising from executing suggested routines or protocols. You must stop the activity in case of pain, dizziness, dyspnea, or any clinical alarm signs. You must consult your treating physician beforehand in case of pregnancy, chronic illness, or comorbidity.
5. Accuracy of AI and laboratory data BioGALF uses probabilistic models and analytics engines that may produce incomplete, outdated, or inapplicable inferences to your clinical context. Therefore, absolute accuracy, completeness, or suitability for critical clinical decisions is not guaranteed. The user is responsible for the truthfulness, legibility, and timeliness of the data entered, including laboratory results and medical history. BioGALF will not be liable for consequences arising from erroneous, incomplete, manipulated, or temporally out-of-context data uploads.
6. Telemedicine and pharmacy services Telemedicine consultations are provided by independent professionals or allied institutions that operate under their own license. Each professional maintains clinical autonomy, prescription criteria, and medical act responsibility in accordance with current regulations. The dispensing and delivery of medications, supplements, or supplies depend on logistics operators, pharmacies, and allied third parties. BioGALF does not guarantee exact delivery times, continuous geographical coverage, or permanent inventory availability. The user must verify contraindications and adherence to prescriptions with their treating physician. Returns and logistical claims are subject to the policies of the third-party operator.
7. Payments, subscriptions, and trial period Plans may include monthly, annual, or free trial modalities. Unless otherwise stated during the purchase, subscriptions automatically renew at the end of each billed period. The user authorizes the corresponding charges and accepts that taxes, bank fees, currency conversions, and gateway commissions may apply according to their jurisdiction and payment method.
8. Intellectual property All software, source code, architecture, interface, BioGALF brand, logos, editorial content, databases, AI models, prompts, methodologies, reports, and associated algorithms are the exclusive property of BioGALF or its licensors. Reverse engineering, decompilation, unauthorized scraping, or mass data extraction is prohibited. Copying, sublicensing, reselling, or commercially exploiting the platform without written license is prohibited. Unauthorized use entitles BioGALF to suspend accounts and take civil and/or criminal actions.
9. Privacy, data, and security The processing of personal data and sensitive health data is governed by the current Privacy Policy, incorporated by reference to these Terms. BioGALF adopts reasonable technical and organizational measures to protect information; however, no system connected to the internet is absolutely invulnerable.
10. Suspension, termination, and restrictions BioGALF may suspend or terminate access, temporarily or permanently, in case of fraud, abusive use, regulatory non-compliance, conduct that endangers third parties, or breach of these Terms. Termination does not exempt the user from paying outstanding obligations nor does it eliminate prior responsibilities.
11. Limitation of liability and indemnity To the maximum extent permitted by law, BioGALF shall not be liable for indirect, incidental, special, punitive damages or lost profits, nor for loss of opportunity, data, or reputation arising from the use or inability to use the platform. The user agrees to indemnify BioGALF against claims from third parties arising from improper use, contractual breach, regulatory violation, or false information provided by the user.
12. Applicable law, jurisdiction, and changes to terms These Terms shall be interpreted in accordance with the applicable law in the jurisdiction of BioGALF's operation, except for mandatory consumer protection regulations applicable in the user's domicile. BioGALF may update these Terms due to regulatory, technological, or business changes. Continued use of the service after the publication of changes will constitute acceptance of the current version.
